Cleaner Hampstead Service Terms and Conditions

These Terms and Conditions set out the basis on which Cleaner Hampstead provides cleaning services to clients. By making a booking with Cleaner Hampstead, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking for services.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Client means any individual, business or organisation that requests or receives services from Cleaner Hampstead.

Services means any cleaning or related services provided by Cleaner Hampstead, including domestic, commercial, end of tenancy, deep cleaning, or other agreed works.

Premises means the property or location where the Services are to be carried out.

Cleaner means an employee, contractor or representative engaged by Cleaner Hampstead to deliver the Services.

Agreement means the contract between the Client and Cleaner Hampstead for the provision of Services, incorporating these Terms and Conditions and any written confirmation or schedule issued by Cleaner Hampstead.

2. Scope of Services

Cleaner Hampstead provides professional cleaning services within its service area, which may include homes, offices, rental properties and other commercial or residential locations. The specific scope of the Services will be confirmed at the time of booking and may include routine cleaning, one-off deep cleans, end of tenancy cleaning, and other associated tasks agreed between the parties.

The Client is responsible for ensuring that the description of the Premises and the required work is accurate and complete at the time of booking. Any additional tasks requested on site that fall outside the original agreement may be subject to additional charges and will be provided at the discretion of Cleaner Hampstead, subject to availability and health and safety considerations.

3. Booking Process

Bookings may be made by the Client through the booking channels made available by Cleaner Hampstead from time to time. By placing a booking, the Client confirms that they have the authority to enter into an Agreement and that all information provided is accurate, current and complete.

A booking is considered an offer by the Client to purchase Services in accordance with these Terms and Conditions. Cleaner Hampstead reserves the right to accept or decline any booking request. Acceptance will be confirmed by Cleaner Hampstead by issuing a booking confirmation, at which point an Agreement will come into existence.

Cleaner Hampstead may, at its discretion, request further information regarding access to the Premises, parking arrangements, special cleaning requirements, security instructions, or any relevant health and safety issues. The Client must inform Cleaner Hampstead of any hazards or particular risks present at the Premises before the Services commence.

Recurring bookings will continue until cancelled in accordance with these Terms and Conditions. The Client is responsible for ensuring that any standing or recurring bookings remain suitable for their requirements and for notifying Cleaner Hampstead of any changes.

4. Access to Premises

The Client must ensure that the Cleaner has safe and reasonable access to the Premises at the agreed time. This includes providing any necessary keys, access codes, permits, or instructions in advance of the appointment. Where keys are provided, Cleaner Hampstead will take reasonable steps to keep them secure but shall not be liable for any loss arising from faulty locks, existing security issues, or previously distributed keys.

If the Cleaner is unable to access the Premises at the scheduled time due to circumstances within the control of the Client, this may be treated as a late cancellation and may incur a cancellation fee as outlined in the cancellation section of these Terms and Conditions.

5. Client Obligations

The Client agrees to provide a safe working environment for the Cleaner and to ensure that basic utilities such as electricity, water and adequate lighting are available during the appointment. The Client must also ensure that any valuable, fragile or irreplaceable items are safely stored away or clearly identified.

The Client should inform Cleaner Hampstead of any specific instructions for the Premises, including any areas that must not be cleaned or any surfaces that require special treatment or products. The Client accepts that failure to provide such information may result in damage or unsatisfactory results for which Cleaner Hampstead shall not be held liable.

Children and pets should be supervised during the appointment to avoid accidents or disruption to the Services. The Client is responsible for ensuring that pets are safely contained if they may pose a risk to the Cleaner or interfere with the performance of the Services.

6. Pricing and Payments

Prices for Services are based on the type of work, the size and condition of the Premises, and the estimated time required to complete the tasks. Cleaner Hampstead reserves the right to adjust prices following a site visit, change in requirements, or where the actual condition of the Premises differs significantly from the description provided at the time of booking.

Unless otherwise agreed in writing, payment for Services is due on or before the day the Services are provided. Cleaner Hampstead may accept various payment methods, including card payments and bank transfers, as communicated to the Client from time to time. The Client agrees to provide accurate payment details and authorises Cleaner Hampstead to charge any outstanding amounts due under the Agreement.

For ongoing or commercial arrangements, Cleaner Hampstead may issue invoices on a weekly or monthly basis, or as otherwise agreed. Payment terms will be stated on the invoice. Late payment may result in the suspension of Services and may incur interest and administrative charges as permitted by applicable law.

Any discounts, promotions or special offers are offered at the discretion of Cleaner Hampstead and may be withdrawn or varied at any time. Such offers are only valid for the period and on the terms stated and cannot be applied retrospectively.

7. Cancellations and Rescheduling

The Client may cancel or reschedule a booking by providing notice to Cleaner Hampstead in accordance with this section. For standard appointments, the Client is requested to give at least 24 hours notice prior to the scheduled start time. For larger projects, deep cleans or end of tenancy work, Cleaner Hampstead may require a longer notice period, which will be communicated at the time of booking.

Where appropriate notice is not given, Cleaner Hampstead reserves the right to charge a cancellation fee, which may be up to the full cost of the scheduled appointment. If the Cleaner arrives at the Premises and is unable to gain access or commence work due to circumstances within the Client's control, this may also be treated as a late cancellation.

Cleaner Hampstead may cancel or reschedule a booking due to unforeseen circumstances such as illness, operational issues, extreme weather, or events beyond its reasonable control. In such cases, Cleaner Hampstead will endeavour to offer an alternative appointment time as soon as reasonably practicable. Cleaner Hampstead will not be liable for any loss or damage arising from such cancellations, provided that any prepayments for Services not delivered are refunded or credited to the Client.

8. Service Standards and Complaints

Cleaner Hampstead aims to provide services with reasonable care and skill. The Client is encouraged to check the work upon completion of each appointment and raise any concerns as soon as possible. If the Client is not satisfied with any aspect of the Services, they should notify Cleaner Hampstead promptly, preferably within 24 hours of the appointment, so that reasonable steps can be taken to address the issue.

Where a complaint is justified and relates to the quality of the cleaning, Cleaner Hampstead may, at its discretion, offer a re-clean of the affected area or another form of reasonable remedy. This will be the Client's exclusive remedy for any alleged shortcomings in the performance of the Services.

9. Use of Cleaning Products and Equipment

Cleaner Hampstead may supply its own cleaning products and equipment or may agree to use products provided by the Client. Where the Client requests that specific products are used, the Client is responsible for ensuring that such products are safe, suitable for the intended surfaces and comply with relevant regulations.

Cleaner Hampstead is not responsible for any damage or adverse effects arising from the use of products supplied by the Client or from products used contrary to manufacturer instructions where the Client has directed their use. The Client agrees to inform Cleaner Hampstead of any known allergies, sensitivities or restrictions relating to cleaning products used at the Premises.

10. Waste and Environmental Regulations

Cleaner Hampstead shall handle regular household and office waste arising from the cleaning process in accordance with applicable waste regulations. The Client is responsible for providing appropriate bins, bags and containers for routine disposal of general waste within the Premises unless otherwise agreed.

Cleaner Hampstead does not typically remove waste from the Premises to external locations. Any removal of waste off site, such as bulky items, construction waste, hazardous materials, clinical waste or electrical items, must be agreed in advance and may incur additional charges. Such removal will be conducted only where permitted by relevant regulations and where Cleaner Hampstead is appropriately licensed or authorised.

The Client must inform Cleaner Hampstead if any area contains hazardous substances, sharp objects, bodily fluids, pest infestations or other materials that may pose a risk to health or safety. Cleaner Hampstead reserves the right to refuse to handle or dispose of any items or materials where this would be unsafe, unlawful or beyond the scope of the agreed Services.

11. Liability and Insurance

Cleaner Hampstead will exercise reasonable care when providing the Services and will maintain appropriate insurance cover as required by law and good industry practice. However, the Client acknowledges that certain risks are inherent in cleaning activities and that minor accidental damage can occasionally occur.

Cleaner Hampstead's total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Client for the specific appointment during which the incident occurred, except where such limitation is not permitted by law.

Cleaner Hampstead shall not be liable for any indirect or consequential losses, loss of profit, loss of enjoyment, or loss of use arising from the performance or non-performance of the Services. Cleaner Hampstead shall also not be liable for pre-existing damage, wear and tear, deterioration due to age or poor condition of surfaces, furnishings or fixtures, or for issues resulting from incorrect installation or construction.

Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

12. Personal Property and Security

The Client is responsible for securing valuable items, confidential documents, cash and jewellery before the commencement of any appointment. Cleaner Hampstead does not accept responsibility for loss of cash, valuables or other items that have not been securely stored.

Where keys or access codes are entrusted to Cleaner Hampstead for ongoing services, reasonable steps will be taken to safeguard them. Keys and access details will not be labelled with the full address of the Premises. In the unlikely event of lost keys, Cleaner Hampstead's liability shall be limited to the reasonable cost of replacement keys or fobs and shall not extend to the replacement of entire lock systems unless required by law or security policy and agreed in writing.

13. Health and Safety

Cleaner Hampstead and its Cleaners will comply with applicable health and safety requirements and will use cleaning methods that are appropriate and reasonably safe. The Client agrees not to request any tasks that may place the Cleaner at risk, such as climbing on unstable surfaces, using unsafe equipment, or handling substances that have not been risk assessed.

The Client must immediately inform Cleaner Hampstead of any incidents, accidents or injuries that occur during or arising from the provision of the Services. Both parties will cooperate to ensure that any necessary reports are completed and any remedial steps are taken.

14. Termination

Either party may terminate an ongoing Agreement for recurring cleaning services by giving reasonable notice to the other party. Cleaner Hampstead may terminate or suspend Services with immediate effect if the Client fails to pay amounts due, behaves abusively towards any Cleaner or representative, allows unsafe conditions at the Premises, or otherwise materially breaches these Terms and Conditions.

Termination of the Agreement will not affect any rights, remedies, obligations or liabilities of either party that have accrued up to the date of termination. Any outstanding fees for Services already rendered shall remain payable.

15. Data Protection and Privacy

Cleaner Hampstead will handle personal information in accordance with applicable data protection laws. Personal data provided by the Client will be used solely for the purpose of administering bookings, delivering Services, managing accounts, and communicating with the Client, except where further use is required by law.

The Client is responsible for ensuring that any personal data relating to third parties present at the Premises is handled lawfully and that the Client has any necessary permissions to allow Cleaners to access the Premises.

16. Changes to Terms and Conditions

Cleaner Hampstead may update or amend these Terms and Conditions from time to time to reflect changes in law, operational practice or service offerings. The most current version will apply to new bookings and to ongoing services after reasonable notice has been given to the Client. Continued use of the Services following such notice will constitute acceptance of the updated terms.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Agreement, or the Services provided by Cleaner Hampstead.

18. General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, such provision shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

No failure or delay by Cleaner Hampstead in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

The Agreement is between Cleaner Hampstead and the Client. No other person shall have any rights to enforce any of its terms. The Client may not assign or transfer their rights or obligations under the Agreement without the prior written consent of Cleaner Hampstead.

By confirming a booking or allowing the Services to commence, the Client acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
